New Jersey estate probate: There is often confusion about the distinction between the administration of an estate and probate. Proving a Will, having the probate court accept a Will as valid and appoint an executor to administer the terms of the Will, and probate are the same legal process. After probate, estate administration begins, the often lengthy, confusing, and stressful process of administering the terms of the probated Will, including identifying property belonging to the estate, identifying Beneficiaries, sale of real estate, filing of numerous Estate Tax, Inheritance Tax, and Income Tax Forms, and a host of other filings and documentations. Our New Jersey estate probate firm helps clients with any or all of the process.
Proving Wills and the probate process are relatively simple in New Jersey. If the estate plan of the deceased includes a current legal Will, properly witnessed, and no one comes forward to contest the Will it can often be done informally, without an appearance in probate court. In other cases probate can be a stressful, sometimes combative, process. New Jersey does recognize Holographic Wills, and probate of these may involve testimony supporting the Will.
